Terms of service
OVERVIEW
These Terms of Service apply to the website and online store operated under the trading name CB Stores. CB Stores is operated by IBK Solutions Ltd, a private limited company registered in England and Wales under company number 17292714, with its registered office at Parker House, 44 Stafford Road, Wallington, Surrey, United Kingdom, SM6 9AA. In these Terms, the words "we", "us" and "our" refer to IBK Solutions Ltd trading as CB Stores.
We operate this store and website, including all related information, content, features, tools, products and services, to provide you with a curated shopping experience (the "Services"). Our online store is powered by Shopify, which enables us to provide the Services to you.
These terms and conditions, together with any policies referred to in them (the "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services.
Please read these Terms carefully. They include important information about your legal rights, ordering, delivery, returns, intellectual property and liability.
By visiting, interacting with or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you should not use the Services. Nothing in these Terms affects any rights you have under applicable consumer law.
SECTION 1 - ACCESS AND ACCOUNT
You must be at least 18 years old to place an order with us. If you are under 18, you may use the Services only with the involvement and permission of a parent or legal guardian.
To use the Services, including browsing our online store or purchasing products or services, you may be asked to provide information such as your email address and billing, payment and shipping details. You confirm that the information you provide is accurate, current and complete and that you are entitled to provide it.
You are responsible for maintaining the security of your account credentials and for activity carried out through your account. You must contact us promptly if you believe your account has been accessed without authorisation. You may not transfer, sell, assign or license your account to another person.
SECTION 2 - OUR PRODUCTS
We take reasonable care to describe and display our products accurately. However, colours and appearance can vary depending on your screen, device and display settings. Minor visual differences caused solely by display technology do not mean that a product is defective or misdescribed.
Products supplied to consumers must be of satisfactory quality, fit for any purpose made known to us and as described. Nothing in these Terms limits your statutory rights. Where an item is pre-owned, vintage, clearance, imperfect or otherwise subject to condition-specific characteristics, we will describe its condition as accurately as reasonably possible.
Product descriptions and availability may be updated from time to time. We may discontinue a product or limit the quantities available to any person, geographic region or jurisdiction. Any such change will not affect an order that we have already accepted, except where required by law or where fulfilment has become impossible for reasons outside our reasonable control, in which case we will contact you and provide an appropriate refund.
SECTION 3 - ORDERS, CANCELLATIONS AND RETURNS
When you place an order, you are making an offer to purchase the products in your basket. An automated acknowledgement does not necessarily mean that we have accepted your order. A contract is formed when we send you confirmation that the order has been accepted or dispatched, depending on the wording of the confirmation we issue. We may decline an order before acceptance, including where a product is unavailable, payment cannot be authorised, a price or description contains a genuine error, or we reasonably suspect fraud or misuse.
We must receive and process payment before dispatch. Please review your order carefully before submitting it. If you ask to cancel or amend an order before dispatch, we will try to accommodate your request but cannot guarantee that this will be possible once fulfilment has begun.
If you are a consumer buying online, you will normally have the right to cancel your order without giving a reason by notifying us within 14 days after the day you, or a person nominated by you, receives the goods. You then normally have a further 14 days to return the goods. Statutory exceptions apply to certain products, including personalised goods and sealed products that are not suitable for return for health-protection or hygiene reasons once unsealed.
Where the statutory cancellation right applies, we will refund the price paid and the cost of our least expensive standard delivery option. We may reduce the refund to reflect any reduction in value caused by handling beyond what is reasonably necessary to establish the nature, characteristics and functioning of the goods. Unless the goods are faulty, not as described or we agree otherwise, you are responsible for the direct cost of returning them.
Further instructions, time limits and any additional voluntary return rights are set out in our Refund Policy. Your statutory rights regarding faulty, damaged, unsafe or misdescribed goods are not affected by that policy or these Terms.
You confirm that purchases are for your own personal or household use and not for unauthorised commercial resale or export.
SECTION 4 - PRICES AND BILLING
Prices, discounts and promotions may change without notice, but changes will not affect an order we have already accepted. The price charged will be the price displayed when the order is placed, subject to correction of an obvious and genuine pricing error before acceptance.
Prices displayed to UK consumers include VAT and other applicable taxes where required. Delivery charges and any optional costs will be shown separately before you submit the order. For international orders, customs duties, import taxes and local handling charges may apply unless checkout expressly states that they are included or collected in advance.
Prices in our online store may differ from those offered in our physical shop or through third-party marketplaces. Promotions may be governed by separate terms. If promotional terms conflict with these Terms, the promotional terms apply to that promotion.
You agree to provide current, complete and accurate purchase, payment and account information and to update it where necessary. You confirm that you are authorised to use the payment method provided and that sufficient funds or credit are available to meet the order total.
SECTION 5 - SHIPPING AND DELIVERY
Delivery dates and times are estimates unless we expressly agree a guaranteed date. We are not responsible for delay caused by events outside our reasonable control, but we will contact you where reasonably possible and take steps to minimise the effect of the delay. Your statutory rights concerning late or non-delivery remain unaffected.
Unless a different period is agreed, we will deliver goods without undue delay and normally within 30 days after the contract is formed. If delivery is substantially delayed, you may have the right to set a further reasonable deadline or cancel the contract and receive a refund in accordance with applicable law.
Goods remain at our risk until they come into your physical possession, or the possession of a person you identify to receive them. If you independently arrange a carrier that we did not offer, risk passes when the goods are delivered to that carrier. Ownership of the goods passes to you once we have received full payment and the goods have been delivered.
SECTION 6 - INTELLECTUAL PROPERTY
Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, video, and audio, and the design, selection, and arrangement thereof, are owned by IBK Solutions Ltd (trading as CB Stores), its affiliates or licensors and are protected by applicable UK and international copyright, trade mark and other intellectual property laws.
These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Services without our prior written consent. Except as expressly provided herein, nothing in these Terms grants or shall be construed as granting a license or other rights to you under any patent, trademark, copyright, or other intellectual property of CB Stores, Shopify or any third party. Unauthorised use of the Services may violate applicable intellectual property laws. All rights not expressly granted herein are reserved by CB Stores.
CB Stores names, logos, product and service names, designs, and slogans are trademarks of CB Stores or its affiliates or licensors. You must not use such trademarks without the prior written permission of CB Stores. Shopify's name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos, product and service names, designs, and slogans on the Services are the trademarks of their respective owners.
SECTION 7 - OPTIONAL TOOLS
You may be provided with access to customer tools offered by third parties as part of the Services, which we neither monitor nor have any control nor input.
You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.
Any use by you of the optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).
We may also, in the future, offer new features through the Services (including the release of new tools and resources). Such new features shall also be deemed part of the Services and are subject to these Terms of Service.
SECTION 8 - THIRD-PARTY LINKS
The Services may contain materials and hyperlinks to websites provided or operated by third parties (including any embedded third party functionality). We are not responsible for examining or evaluating the content or accuracy of any third-party materials or websites you choose to access. If you decide to leave the Services to access these materials or third party sites, you do so at your own risk.
We are not liable for any harm or damages related to your access of any third-party websites, or your purchase or use of any products, services, resources, or content on any third-party websites. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products and services should be directed to the third-party.
SECTION 9 - RELATIONSHIP WITH SHOPIFY
Our online store is powered by Shopify, which provides the ecommerce platform used to make the Services available. Any contract for the purchase of products from our store is made directly between you and IBK Solutions Ltd trading as CB Stores. Shopify is not the seller of our products and is not responsible for fulfilling your order.
To the extent permitted by law, Shopify and its affiliates are not responsible for loss, damage or claims arising from products purchased directly from us. Nothing in this section limits any rights or remedies that cannot lawfully be excluded.
SECTION 10 - PRIVACY POLICY
All personal information we collect through the Services is subject to our Privacy Policy, which can be viewed here, and certain personal information may be subject to Shopify's Privacy Policy, which can be viewed here. By using the Services, you acknowledge that you have read these privacy policies.
Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Information you submit to the Services will be transmitted to and shared with Shopify as well as third parties that may be located in other countries than where you reside, in order to provide services to you. Review our privacy policy for more details on how we, Shopify, and our partners use your personal information.
SECTION 11 - FEEDBACK
If you submit, upload, post, email, or otherwise transmit any ideas, suggestions, feedback, reviews, proposals, plans, or other content (collectively, "Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute and display such Feedback in any medium for any purpose, including for commercial use. We may, for example, use our rights under this license to operate, provide, evaluate, enhance, improve and promote the Services and to perform our obligations and exercise our rights under the Terms of Service.
You also represent and warrant that: (i) you own or have all necessary rights to all Feedback; (ii) you have disclosed any compensation or incentives received in connection with your submission of Feedback; and (iii) your Feedback will comply with these Terms. We are and shall be under no obligation (1) to maintain your Feedback in confidence; (2) to pay compensation for your Feedback; or (3) to respond to your Feedback.
We may, but have no obligation to, monitor, edit or remove Feedback that we determine in our sole discretion to be unlawful, offensive, threatening, libellous, defamatory, pornographic, obscene or otherwise objectionable or violates any party's intellectual property or these Terms of Service.
You agree that your Feedback will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your Feedback will not contain libellous or otherwise unlawful, abusive or obscene Feedback, or contain any computer virus or other malware that could in any way affect the operation of the Services or any related website. You may not use a false email address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any Feedback. You are solely responsible for any Feedback you make and its accuracy. We take no responsibility and assume no liability for any Feedback posted by you or any third-party.
SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS
We take reasonable care to ensure that product information and order details are accurate. However, our website, product listings, checkout or communications may occasionally contain typographical, pricing, description, inventory, availability, promotional, discount, tax, delivery, payment-processing or other administrative or technical errors.
We reserve the right to correct any error, inaccuracy or omission, update information, withdraw a product or promotion, and decline or cancel an affected order where permitted by law. This includes orders affected by an obviously incorrect price, a product incorrectly displayed as free, an unintended discount, inaccurate stock information, or a technical or system error.
An order submitted through our website constitutes an offer to purchase. Acceptance takes place only in accordance with the order-acceptance provisions set out in these Terms. If we identify an error before accepting an order, we may decline the order and refund any payment received.
If a material error is identified after an order has been accepted, we will contact you promptly and explain the available lawful options. These may include supplying the order on the corrected terms with your agreement, offering a suitable alternative, or cancelling the affected item or order and issuing a full refund, including any delivery charge paid for an order that is cancelled in full.
Nothing in this section limits or excludes any rights or remedies that cannot lawfully be limited or excluded under applicable consumer law.
SECTION 13 - PROHIBITED USES
You may access and use the Services for lawful purposes only. You may not access or use the Services, directly or indirectly: (a) for any unlawful or malicious purpose; (b) to violate any international, national or local laws, regulations or legally binding requirements; (c) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (d) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or harm any of our employees or any other person; (e) to transmit false or misleading information; (f) to send, knowingly receive, upload, download, use, or re-use any material that does not comply with these Terms; (g) to transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation; (h) to impersonate or attempt to impersonate any other person or entity; or (i) to engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Services, or which, as determined by us, may harm CB Stores, Shopify or users of the Services, or expose them to liability.
In addition, you agree not to: (a) upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Services; (b) reproduce, duplicate, copy, extract, sell, resell or exploit any portion of the Services; (c) collect or track the personal information of others; (d) spam, phish, pharm, or pretext or otherwise misuse the Services; (e) use any robot, spider, scraping, data gathering and extraction tools, automatic devices or processes, AI tools (such as agentic AI) or automated or manual means to access the Services; or (f) interfere with, bypass, or circumvent the security or authorization features, robot exclusion headers, or other measures we employ to restrict access to the Services. We reserve the right to suspend, disable, or terminate your account at any time, without notice, if we determine that you have violated any part of these Terms.
SECTION 14 - AGENTS
14.1 This section ("Agent Terms") applies if you use, allow, enable, or cause the deployment of an Agent to access, use, or interact with any Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person or entity and that can be executed on behalf of or using a person's device, without direct supervision.
14.2 No Agent may access, use, or interact with Services unless, at all times, it identifies itself and operates in strict accordance with the requirements in section 14.4 below. In addition, no Agent may access, use, or interact with Services if we have requested that the Agent refrain from accessing, using, or interacting with any service.
14.3 We may limit, including by technical measures, whether and how any Agent accesses, uses, and interacts with Services.
14.4 Agents must: (i) in all HTTP/HTTPS requests, identify that the request is from an Agent and disclose the name of the Agent by including the following in the request's user agent string: "Agent/[agent name]"; (ii) not conceal or obfuscate that any access, use, or interactions are from an Agent, such as by (a) mimicking human behaviour and interaction patterns, or (b) completing or circumventing CAPTCHAs or measures intended to distinguish computer use from humans, (iii) respond truthfully to any question or prompt seeking to determine if interactions are coming from a human or a computer, (iv) not circumvent or otherwise avoid any measure intended to block, limit, modify, or control whether and how Agents access, use, or interact with the Services.
SECTION 15 - SUSPENSION AND TERMINATION
We may suspend or terminate your access to the Services where you materially breach these Terms, use the Services unlawfully, create a security or fraud risk, or where we are required to do so by law. Where reasonably possible, we will provide notice, but immediate action may be necessary in serious cases.
Suspension or termination of website access does not remove any rights or obligations relating to an order that we have already accepted, unless the order is lawfully cancelled and any required refund is made.
The provisions concerning intellectual property, feedback, liability, severability, governing law and any other terms that by their nature should continue will survive termination.
SECTION 16 - WARRANTIES AND STATUTORY RIGHTS
Nothing in these Terms excludes or restricts any statutory right or remedy available to you as a consumer. In particular, goods supplied to consumers must be of satisfactory quality, fit for purpose and as described, subject to the Consumer Rights Act 2015 and other applicable law.
Information provided through the Services is for general information. We take reasonable care over its accuracy but do not guarantee that general editorial or informational content will always be complete, current or suitable for a particular purpose. This does not affect our responsibility for product descriptions, pre-contract information or any other information that the law requires us to provide accurately.
We do not guarantee that access to the website will always be uninterrupted or error-free. We may temporarily suspend access for maintenance, security, technical or operational reasons.
SECTION 17 - LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of your statutory consumer rights, or any other liability that cannot lawfully be excluded or limited.
If you are a consumer, we are responsible for loss or damage that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable. We supply products for domestic and private use; unless we have expressly agreed otherwise, we are not liable for business losses such as loss of profit, revenue, business opportunity, goodwill or data arising from a consumer purchase.
We are not responsible for loss caused by your failure to follow reasonable instructions, by unauthorised use of your account, or by events outside our reasonable control, except where the law provides otherwise.
SECTION 18 - RESPONSIBILITY FOR MISUSE
You are responsible for losses we reasonably and foreseeably suffer as a direct result of your unlawful use of the Services, fraud, deliberate misconduct or material breach of these Terms. This section does not require a consumer to compensate us for losses caused by our own breach, negligence or failure to comply with the law.
Where a third party makes a claim arising directly from your unlawful use of the Services or infringement of that third party's rights, you agree to provide reasonable cooperation in responding to the claim.
SECTION 19 - SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
SECTION 20 - WAIVER; ENTIRE AGREEMENT
If we do not immediately enforce a right or remedy under these Terms, that does not mean we have waived it. A waiver is effective only where clearly given and applies only to the specific circumstances for which it is given.
These Terms, together with the policies and information expressly incorporated into them, form the agreement between you and us concerning use of the Services and purchases made through the online store. They do not exclude any statement or information that is legally binding as pre-contract information, and they do not limit rights that cannot lawfully be excluded.
SECTION 21 - ASSIGNMENT
You may not transfer your rights or obligations under these Terms without our written consent, except where the law allows otherwise. We may transfer our rights and obligations to another organisation, but only where doing so does not reduce your rights under these Terms. We will notify you where required by law.
SECTION 22 - GOVERNING LAW AND JURISDICTION
These Terms and any contract between you and us are governed by the laws of England and Wales.
If you are a consumer resident in England or Wales, the courts of England and Wales will have jurisdiction. If you are a consumer resident in Scotland, you may bring proceedings in Scotland or England and Wales. If you are a consumer resident in Northern Ireland, you may bring proceedings in Northern Ireland or England and Wales. Consumers living outside the United Kingdom may also benefit from mandatory protections and jurisdiction rights under the law of their country of residence.
SECTION 23 - HEADINGS
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.
SECTION 24 - CHANGES TO TERMS OF SERVICE
You can review the most current version of the Terms of Service at any time on this page.
We reserve the right, in our sole discretion, to update, change, or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. We will notify you of any material changes to these Terms in accordance with applicable law, and such changes will be effective on the date specified in the notice. Your continued use of or access to the Services following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
